What Are the 3 Biggest Problems I Will Face When Setting Up an Estate Plan?

1. Procrastination

“Procrastination makes easy things hard, hard things harder.”
– Mason Cooley.

You may procrastinate because you think that estate planning is too expensive when, in reality, it is far more costly to have no plan.

You may feel you don’t have enough money or assets. When the most economical and efficient way to protect what you have worked so hard to build for your family is to have an Estate Plan.

You may think you are too young for an Estate Plan. Planning your estate is critical to assure your minor child is taken care of how you wish. And, your estate is managed for the benefit of your child as long as you want.

2. You find it uncomfortable discussing “death”

“While I thought I was learning how to live, I have been learning how to die.”
– Leonardo da Vinci.

Sometimes thinking about the world without you in it is difficult. However, by not considering the “what ifs” your property, debts, family members, all of your most private matters can be open to the public to see in probate court. More importantly, the opportunities to create a financial world to benefit your children, your children’s children, and future generations will be lost. View these opportunities as life affirming. With your Estate Plan you create a world where you and your loved ones have the opportunity to be your very best versions of you.

3. You are not sure who to ask for help

“Help! I need somebody. Help! Not just anybody. Help! You know I need someone. Help!”
– John Lennon.

The world has become more complex, and so have trusts and Estate Plans. Choosing a “one size fits all” law firm may not provide the best plan for your family’s future.

A law firm that focuses on estates and trusts is more likely to identify areas that could cause problems for you or your loved ones in the future. They are also more likely to keep up-to-date with current issues, drafting techniques, and changes in law or regulations that affect your Estate Plan.

If your plan is not executed correctly, even if it is in writing, it will not provide the full benefits you need. Often the critical “funding” stage is missed or short-changed, so the actual value of the Estate Plan is lost. You should work with someone who understands the importance of following through with action after the documents are signed.
